This document is the Licensed Application End User License Agreement for Pawsy. It supplements, and incorporates by reference, Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If anything here conflicts with the Apple Standard EULA, the Apple Standard EULA controls except for the additional terms we are expressly permitted to add (including the medical/veterinary disclaimer and subscription terms below).
This EULA is between you and Timur Iuldashev only, and not with Apple. Apple is not responsible for the App or its content. The App is licensed, not sold, to you for use only under the terms of this EULA and the Apple Standard EULA. We, not Apple, are solely responsible for the App and its content.
We grant you a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. You may not distribute, copy, reverse-engineer, modify, or create derivative works of the App except as permitted by law.
Pawsy offers an auto-renewable subscription called Pawsy Premium, which unlocks premium features. The following disclosures are required by Apple and apply to all subscriptions:
We may change subscription prices and offerings; any price change will apply only to future billing periods and, where required, will be communicated to you with the opportunity to cancel.
Some features (for example, the toxic-food/plant checker and emergency-vet information) may be available without a subscription. Free use may be subject to usage limits (for example, a limited number of chats or photo scans per day). Limits and the set of free versus premium features may change over time.
Pawsy is an informational tool only. It is not a medical device, it does not provide a diagnosis, and it is not a substitute for professional veterinary care.
You are responsible for the content you submit (photos, text, lab images, profile data). Do not submit content you do not have the right to share. Your inputs are processed by AI providers to generate responses; see our Privacy Policy. We may apply safety filtering and reasonable limits to inputs.
You agree that we may collect and use technical data and related information, and your content, as described in our Privacy Policy at https://pawsy-legal.vercel.app/privacy, to operate, provide, and improve the App. Your use of the App is also subject to that Privacy Policy.
To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI outputs will be accurate or reliable. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
To the maximum extent permitted by law, in no event will Timur Iuldashev be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your reliance on App content or AI outputs, including any harm to your dog's health resulting from decisions made using the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App or subscription in the 12 months before the claim.
We, not Apple, are solely responsible for providing maintenance and support for the App, as required by law. You may contact support at https://pawsy-legal.vercel.app or vibefactory22@gmail.com. Apple has no obligation to furnish any maintenance and support services with respect to the App.
Your use of the App must comply with applicable third-party terms (e.g., your wireless data plan). Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, Timur Iuldashev, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by this EULA.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
This license is effective until terminated by you or us. Your rights end automatically if you fail to comply with any term. Upon termination you must stop using and delete the App. Sections that by their nature should survive (disclaimers, liability limits, governing law) survive termination.
Except to the extent expressly provided otherwise, this EULA is governed by the laws of Georgia, without regard to conflict-of-laws principles, and excluding the U.N. Convention on Contracts for the International Sale of Goods.
